The company SILHUETA PROTAGONISTA LDA. may, from time to time, change these General Terms and Conditions.

By accessing the website www.pedroguimaraesart.com, customer agrees to comply with the "General Terms and Conditions of Sale". It is considered that, when an order is validated, the customer is automatically accepting our "General Terms and Conditions".

To register on the website www.pedroguimaraesart.com, you must use the "Account" link and fill in the requested information. The registration process is quite simple. We only collect the necessary information to identify, contact and provide personalized customer service.

The process consists of two phases:

The product photographs presented here are for illustration purposes only. Regarding to serigrahs, each produced work is unique and unrepeatable due to the artist's personalized intervention. There is no serigraph that is the same as another. When purchasing a work by Pedro Guimarães, you are choosing a piece that is unique. By selecting one of the presented works, you have the guarantee of similarity in the work that will be delivered to you, but not the commitment on the part of PEDRO GUIMARÃES ARTISTA PLÁSTICO that the piece will be exactly the same, nor is that the artist's intention.

Availability
PEDRO GUIMARÃES ARTISTA PLÁSTICO respects the deadlines of an order as long as there is stock availability. In the event that one of the ordered products is not available in stock, PEDRO GUIMARÃES ARTISTA PLÁSTICO will contact the customer by email or phone within 48 hours from the date of the order, in order to inform the new delivery time of the product or request its change to another similar one.

It is PEDRO GUIMARÃES ARTISTA PLÁSTICO's policy to only present products for sale that are in stock in their studio, and there may be a discrepancy between the quantities presented for sale on the website www.pedroguimaraesart.com and the quantities available in stock due to technical or circumstantial issues.

Exchange and Returns Policy
In compliance with Article 4 of Portuguese DL no. 24/2014, of February 14th, and in accordance with Article 10 and 11, if the customer wishes to return one or more items, they may do so without incurring any costs and without the need to indicate a reason, within 14 days after receiving the order, provided that the products are intact, sealed, complete, and within the original packaging, which cannot be damaged, altered or scratched. The customer must ensure that the returned item(s) arrive(s) at our premises within 14 days from its delivery.

In case the item is defective, this period is extended to 30 days.

Return shipping costs will be responsibility of PEDRO GUIMARÃES ARTISTA PLÁSTICO only in case the return results from our error (incorrect or defective item).

To exercise your right to return, log in to your account, view your orders, and click 'Return item(s)'. Fill in the form fields with the information regarding the return and submit. We will notify you by email of your refund as soon as we receive and process the returned item. Alternatively, you can contact our Customer Support team via email at info@pedroguimaraesart.com, indicate the reason, specify the order number, description, or reference of the product(s) you wish to return. The refund will be made through the original payment method.

Customer must also note whether the product they wish to return was acquired within any promotional campaign and if, for that reason, they benefited from any complimentary item. If so, they must return not only the product in question but also the complimentary item that was given with their purchase. Both products must comply with the aforementioned guidelines.

Only the return of a complete pack is possible. If the customer wishes to return a product that belongs to a pack, they must return all the products that make up that same pack. All products must comply with the aforementioned guidelines.

Customer must send us the item(s) to the following address and in perfect condition accompanied by the respective documents sent to them, via postmail or carrier, with the return costs being borne by the customer:

Returns of incomplete, damaged or scratched products, as well as products without the original packaging and/or label, or products with signs of being used, will not be accepted.

If we receive an item in the conditions mentioned above, the customer will lose the right to be refunded and will have 10 days to collect the item(s) at our premises, bearing the collection costs.

The refund will be processed and verified within a maximum period of four weeks after the return is initiated. This period includes the transit time until we receive your return by the carrier (5 to 10 business days), the processing time of your return after receipt (3 to 5 business days), and the bank processing time for refunding the amount to be refunded (5 to 10 business days).

Warranties and after-sales service
All products sold benefit from an artist's compliance guarantee, without prejudice to applicable legal warranties.

Shipping methods
PEDRO GUIMARÃES ARTISTA PLÁSTICO delivers orders through a subcontracted carrier. Each shipment is accompanied by an envelope containing the following documents: Invoice/Receipt. Product deliveries will only take place on business days.

As an indication, without any commitment on the part of PEDRO GUIMARÃES ARTISTA PLÁSTICO and subject to product unavailability or other occasional causes of force majeure, the merchandise will be delivered according to the following deadlines:

The delivery time is 2 business days for Portugal mainland, which can be extended to 5 days for the islands, and starts from the moment payment is confirmed. The delivery time within the European Union, United States, and United Kingdom is 3 to 5 days, which can be extended to 12 days due to customs procedures. Delivery times for other countries are variable and will be provided upon request.

Delivery times are indicative and therefore considered valid when there are no physical or structural impediments (e.g., incorrect addresses or force majeure delays). The transport cost, which may be added to the price of purchased products, will be automatically calculated by the system. In case the order is not received within the indicated deadlines, an investigation will be conducted with the carrier, which may take a few days.

Customer must contact PEDRO GUIMARÃES ARTISTA PLÁSTICO Customer Service. During this period no refund can be issued until the hypotetical loss of the order is verified and confirmed.

Customer has the right, at the time of receiving the order, to open the package to verify that the product corresponds to what was ordered and does not have any external defects.

If the product is not the one ordered or presents visible defects, PEDRO GUIMARÃES ARTISTA PLÁSTICO advises the customer to return it, sending it to the address of the company that owns PEDRO GUIMARÃES ARTISTA PLÁSTICO brand. An email must also be sent within 24 hours indicating the problem to the Customer Service at info@pedroguimaraesart.com.

Please note that PEDRO GUIMARÃES ARTISTA PLÁSTICO will be obliged to refuse any request for refund or replacement (right of Revocation) for products that have external defects that were accepted by our customers at the time of delivery. The right of revocation remains valid for cases of defects that are detected by the customer after delivery and in accordance with the terms provided by law.

What to do at the time of delivery:

Check if the package is in perfect condition.
Open the package and ask the carrier to wait for verification (this is a right of the customer).
Verify that the product is as requested and does not have any visible defects. If everything is in order, accept the delivery.
If there is any non-compliance, such as an error in the requested product or a visible defect, refuse the delivery, indicating the problem on the carrier's transport document.

To avoid any delays and to allow for the verification of data if necessary, the customer must provide the following information at the time of purchase:

- An email address;

- A phone number so that we can contact you.

PEDRO GUIMARÃES ARTISTA PLÁSTICO apologizes for any inconvenience caused, but these measures must be taken to protect customers from potential fraud.

Disputes and liabilities
For the resolution of any dispute arising from the interpretation or execution of these General Terms and Conditions, the Vale do Ave Consumer Conflict Arbitration Center (www.triave.pt) shall be competent.

PEDRO GUIMARÃES ARTISTA PLÁSTICO shall not be liable for delays or breaches of contract due to force majeure: disturbance, total or partial strike of postal services and means of transportation or communication, flood, fire, or war.

PEDRO GUIMARÃES ARTISTA PLÁSTICO shall not be liable for any indirect damage: loss of business, loss of profit, loss of opportunity, damage or fees that may arise from the purchase of any product presented on the site.

PEDRO GUIMARÃES ARTISTA PLÁSTICO's works are not aimed at a professional audience. PEDRO GUIMARÃES ARTISTA PLÁSTICO shall not be liable for any damage resulting from use within a professional activity.
